Terms of Service

These terms explain the rules for using the Wyatt Kohl Music website and its authorized social publishing features.

Effective date:

Please read these Terms of Service before using the website or any social publishing feature. By accessing or using the service, you agree to these terms. If you do not agree, do not use the service.

The page may be translated using the language selector for convenience. If a translation differs from the English text, the English text controls to the extent permitted by applicable law.

01

Who provides the service

“Wyatt Kohl Music,” “we,” “us,” and “our” refer to the Wyatt Kohl Music website and the people authorized to operate it. These terms apply to the public website and to social publishing tools made available through it.

Questions about these terms may be sent to contact@wyattkohlmusic.com using the branded email chooser. Choose Gmail, Outlook, Yahoo Mail, or your device’s default mail app. The selected provider opens a draft to us with “Terms of Service Question” in the subject; you review and send it yourself. The website does not send the message on your behalf.

02

Who may use publishing features

The TikTok draft-upload feature is intended for the owner of the official Wyatt Kohl Music TikTok account and people the owner has authorized to act for that account. You must have authority to connect the account and submit content. Do not connect an account that you do not own or have permission to manage.

03

What the service does

The website provides music and artist information. A TikTok connection and draft-upload feature is being prepared and will be available only after it is enabled and any required TikTok review is complete. With the currently selected video.upload permission, an authorized operator can send a video to TikTok as a draft for the account owner to review and finish in TikTok. It does not directly publish a public post.

Browser-controlled media playback. Browsers decide whether media can start automatically, particularly when it includes sound. This site does not try hidden media or check browser restrictions on every page. If the YouTube player reports that a requested playback attempt was blocked, the site may show a one-time notice with instructions for your browser. The site cannot change browser settings. You can start playback using the player controls or change available permissions in your browser. Dismissing the notice is remembered for the current tab session.

The restricted Security Admin dashboard also provides an optional AI assistant to authorized operators. When the Owner uses it, submitted prompts and optional screenshots are sent to OpenAI through its API for a response. Do not submit passwords, access codes, API keys, subscriber records, or other sensitive information. OpenAI processes those inputs under its own terms and data controls; see the OpenAI API data controls.

Where enabled, the YouTube Command Center sends selected employee recipients 60-minute and 30-minute Premiere reminders, records send and acknowledgment status, and stores those records in a restricted server-side file. See the Privacy & Security notice for the related data practices and retention.

Features may change, be limited, or be unavailable. TikTok controls its own review, publishing, privacy options, account access, and platform availability.

04

TikTok account connection and authorization

Connecting a TikTok account uses TikTok’s authorization process. The service does not ask for or store the TikTok account password. If you approve the connection, TikTok provides the permissions needed for the enabled feature. You may revoke those permissions through TikTok’s account or app settings; doing so can stop the publishing feature from working.

Only the account owner or an authorized operator may approve or use the connection. Keep access to the website and connected accounts secure, and promptly report suspected unauthorized use to the contact address above.

05

Posts and your control

You are responsible for reviewing the video and caption before upload. With video.upload, the service submits a draft to TikTok; the account owner must use TikTok’s inbox notification to continue editing and complete the post in TikTok. This feature does not directly publish a public post. TikTok may reject, delay, limit, remove, or change the visibility of content.

We do not promise that a post will publish, remain available, reach a particular audience, or produce a particular result. A publishing status or receipt from the service is not a guarantee of ongoing availability on TikTok.

06

Your content and permissions

You retain your rights in content you provide, subject to rights held by other people. You confirm that you own or have obtained every permission needed to upload and publish each video, image, sound recording, musical composition, caption, name, likeness, and other material you submit. This includes any rights needed to publish the material on TikTok and other selected platforms.

You give Wyatt Kohl Music permission to process and transmit the content and post information you submit solely to provide the publishing feature you requested, maintain its security, and troubleshoot its operation. This limited permission does not transfer ownership of your content to Wyatt Kohl Music.

07

Use of TikTok, YouTube, and other services

TikTok is a separate service operated by TikTok. Your TikTok account and content remain subject to TikTok’s Terms of Service, Community Guidelines, privacy terms, and other applicable rules. You must follow those rules as well as applicable copyright and other laws. Wyatt Kohl Music is not affiliated with or endorsed by TikTok.

We cannot control TikTok’s systems, policies, decisions, outages, or handling of content after it is submitted to TikTok.

08

YouTube account connection, search, and media player

The website offers YouTube-related media features, including a media player and, where available, the ability to search YouTube and select videos to play. You may choose to connect a Google/YouTube account for account-connected player features. Google displays the permission request; the current connected-player scope is read-only. The website does not ask for or store your Google or YouTube password. By using a YouTube API feature, you also agree to be bound by the YouTube Terms of Service, as required for those features.

To provide these features, the site may send search requests to YouTube and receive video information and account information that the permissions allow, such as a basic account identifier or profile details. YouTube video content is played through YouTube's player and remains subject to YouTube's availability and controls. Search results can change, videos can become unavailable, and playback may depend on your device, region, account, or YouTube settings. The website does not provide a way to download YouTube videos.

Use the YouTube connection control on the Media page to disconnect; where Google’s revocation service is available, the site revokes the access token and clears the token and related YouTube caches from that browser. You may also revoke access at Google Account security settings. If you revoke there, return to the Media page so the site can detect the revoked token and clear its local connection data, or clear the site's local storage in your browser. Revocation may disable account-connected features. Use of these features is also subject to the YouTube API Services Terms of Service, YouTube API Services Developer Policies, and Google's Privacy Policy. Those third-party rules and policies may change.

09

Privacy and security

Information handled by the website and its publishing features is described in the Wyatt Kohl Music Privacy and Security notice. The publishing feature may process the connected TikTok account identifier and basic profile information, approved permission scopes, authorization-token status, the video and caption submitted, selected post settings, and posting status or error records. Video and post details are sent to TikTok to carry out an authorized submission. Authorized administration may also include the dashboard AI assistant and scheduled employee Premiere reminders described in the Privacy & Security notice.

Access tokens are credentials and must be protected. Authorized employee and administrative accounts are individual and may require account credentials and additional verification. Five unsuccessful attempts in a verification flow may pause that route for 10 minutes; password and access-code recovery options are available as described in the Privacy & Security notice. You must keep issued credentials private and promptly report suspected loss or misuse. We may record limited account-security and administration events, restrict or revoke access when an account is disabled or misuse is suspected, and retain related records as described in the Privacy & Security notice. We will store any tokens used by the enabled integration on the server, restrict their use to authorized publishing functions, and remove or disable them when the connection is revoked or no longer needed, subject to necessary security records. We do not store your TikTok password.

10

Prohibited use

You may not use the service to access an account without permission, infringe another person’s rights, submit unlawful or deceptive content, spam or harass people, interfere with the website, bypass security controls, or use the TikTok connection outside the permissions you granted.

11

Suspension and disconnection

We may suspend or disable access when reasonably necessary to protect the website, an account, a person, or the service; respond to suspected misuse; comply with law; or meet a platform requirement. You may stop using the service and revoke the TikTok authorization at any time. Disconnecting may prevent future publishing but does not remove content already submitted to TikTok or records that must be retained for security or legal reasons.

12

Availability, warranties, and responsibility

The website and its features are provided on an “as available” basis. To the extent permitted by applicable law, we disclaim warranties that the service will be uninterrupted, error-free, secure in every circumstance, suitable for a particular purpose, or compatible with every device or third-party platform. We do not guarantee the accuracy or continued availability of third-party content, search results, or account data.

To the extent permitted by applicable law, Wyatt Kohl Music will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from use of the website or a third-party service. This does not exclude responsibility for platform outages or decisions, or content-rights problems arising from material you submit, to the extent those matters are outside our control.

Nothing in these terms excludes or limits a right or liability that cannot be excluded or limited under applicable law.

13

Website materials and intellectual property

The website’s original text, design, graphics, logos, and Wyatt Kohl Music brand materials are owned by Wyatt Kohl Music or used with permission, and are protected by applicable intellectual-property laws. You may view and link to public pages for personal, lawful use. You may not copy, modify, redistribute, commercially exploit, or use our name, marks, artwork, or other protected materials in a way that suggests endorsement without prior permission, except where applicable law allows.

Music, video, artwork, and other materials belonging to third parties remain subject to their owners’ rights and the terms of the services through which they are made available.

14

Changes to these terms

We may revise these terms as the website and publishing features change. The effective date at the top identifies the current version. If a change materially affects how the service works, we will provide notice through an appropriate website notice before the changed feature is used, where required.

Community comments and Echoes

Selecting a country is required to submit an Echo. State, province, region, and city are optional and may be left blank. The selected country and any region or city you provide are stored with your Echo and shown publicly when it is published. The picker uses CountriesNow to retrieve location choices through the website server. Its lists may be incomplete or inaccurate, and you may type a city if it is missing from suggestions. Custom emoji selections are submitted as text tokens, and GIF selections store a GIPHY identifier; GIF media loads from GIPHY and remains subject to GIPHY’s terms. Wyatt Kohl Music may hold submissions for review or remove content that violates these terms. You must not post private or sensitive information in a public Echo.

The Home page comment form and Echoes archive let visitors share a name or handle, location, message of up to 500 characters, and selected avatar. Clean submissions publish publicly with their posting time. Do not include private, confidential, or sensitive information. Do not submit unlawful, abusive, hateful, harassing, obscene, threatening, misleading, or spam content, or content that violates another person’s rights.

You are responsible for the content you submit and must have the rights needed to share it. By submitting a comment, avatar, or optional image or video attachment, you give Wyatt Kohl Music a non-exclusive, worldwide, royalty-free permission to store and review that submission and, only after an authorized Owner or Manager approves the file and the associated Echo for public display, to display, format, and reproduce it as part of operating and presenting the website. Attachments remain private unless explicitly approved. This permission lasts while the submission is retained and ends when it is deleted, except for copies that may persist temporarily in backups or browser caches.

Echo submissions may be screened by automated rules. Likely profanity or abusive-content matches are held privately for low-severity human review. High-confidence commercial spam signals, including listed promotional phrases, a domain or URL in the message, or four or more hashtags, may be marked high severity and cause a 15-minute pause on Echo submissions from the associated browser marker while an Owner or Manager reviews the entry. A filter match is not an official strike, and no permanent restriction is applied automatically. An Owner or Manager may release a false positive without a strike and lift the associated temporary spam cooldown. Only a human-confirmed violation creates an official strike; a second active confirmed strike starts a 15-minute Echo-only cooldown. A permanent restriction requires at least three active confirmed strikes and a separate recorded Owner or Manager decision. Restrictions apply to Echo submissions associated with a first-party browser marker, not a verified identity or the entire website. For Echo moderation, the private ledger records a keyed hash of a random first-party browser marker and the masked network prefix derived from the IP address received by the server (IPv4 /24 or IPv6 /64), together with the filter category/reason, comment reference, timestamps, and human decision details. These pseudonymous signals are used for internal moderation, anti-bot and abuse prevention, fraud prevention, and platform security/stability; the marker and prefix are matching signals, not identity-verification tools; the event remains linked to the submitted Echo for authorized review. The workflow does not use canvas or device fingerprinting, reverse-IP identity enrichment, or cross-site advertising. Unresolved events remain in the review queue until authorized review. Resolved event rows are eligible for deletion once they are at least 365 days old from event creation, on the next cleanup pass. When a held Echo is approved, no moderation status, notes, marker hash, or network prefix are included in the public post; the separate private event remains subject to that retention schedule. Strikes expire after 365 days. Do not submit unlawful, abusive, hateful, harassing, obscene, threatening, misleading, commercial-spam, or rights-infringing content. Contact contact@wyattkohlmusic.com to ask about an Echo review or restriction.

The picker also offers optional GIPHY GIFs. When you search or attach a GIF, your browser communicates directly with GIPHY; GIPHY may receive search terms, ordinary request/device data, and a random analytics ID saved for the active tab session under its GIPHY Privacy Policy. We store only the GIF’s alphanumeric GIPHY ID with the public comment. Your browser loads the media directly from GIPHY and sends the required view, click, and successful-send analytics events. We do not download or store external GIF URLs or files. GIPHY content remains subject to GIPHY’s Terms.

17

Site-owned materials and intellectual property

Except for visitor submissions and third-party materials, the original website materials that Wyatt Kohl Music or its legal owners create or own—including custom visual layouts and interface designs, background source-code scripts, moderation and security logic including cryptographic filtering matrices, specialized media-player assets, ambient audio-loop configurations (including vinyl-dust settings), dashboard mechanics, and original avatar and emoji artwork—are proprietary materials protected by applicable intellectual-property laws. Third-party assets remain subject to third-party ownership rights and licenses. These Terms do not grant permission to copy, redistribute, commercially exploit, or use site-owned materials beyond lawful viewing and linking. You may not bypass access controls or use automated extraction in violation of applicable law or these Terms. This clause does not claim ownership of standard visitor text submissions and does not restrict rights or exceptions that applicable law preserves; visitor-content permissions are described in the Community comments and Echoes section.

Media player, equalizer, and visual effects

The Media page may offer YouTube playback and, when available, native Wyatt Kohl Music audio. The equalizer and live spectrum analyzer apply only to native Wyatt Kohl Music tracks that the site is authorized to process. They do not process, separate, or modify YouTube audio. During YouTube playback, the cassette reels follow the player playback state; the spectrum and fader display are decorative only and do not measure or change the YouTube audio. YouTube playback remains in YouTube's player and subject to YouTube's controls and applicable terms.

09

Private media delivery

Some site-owned avatar artwork and atmosphere audio are delivered through a first-party PHP stream using signed, time-limited asset links and same-site request checks. Do not attempt to bypass those checks, interfere with the stream, or use it to access assets outside the published catalog. The stream reduces exposure of storage locations and casual hotlinking. It cannot prevent saving or capturing content that your browser is allowed to display or play.

Media delivery may generate ordinary hosting access-log records. Site content remains subject to the intellectual-property and permitted-use rules in these Terms. For the associated data practices, see the Privacy & Security notice and, for California-specific information, the California Privacy Rights page.

Employee-only OBS launcher terms

This optional feature is limited to authorized employees using the authenticated Command Center. If OBS is not found, the employee may separately consent to a local search of mounted internal or external drives. Protected drives must be unlocked through the operating system; the launcher does not collect drive passwords. Search paths and results remain on the device and are not sent to the website by the launcher. Full details are in the authenticated Employee Privacy & Security notice. This section does not apply to public visitors.
